Important: These Terms and Conditions ("Terms") govern your use of the Souvi mobile application and services ("Service") operated by AgnelDorian ("us," "we," or "our"). By downloading, accessing, or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using Souvi in any way, you confirm that:
- You are at least 16 years old
- You have the legal capacity to enter into these Terms
- You agree to comply with all applicable laws and regulations
- All information you provide is accurate and complete
If you do not agree with any part of these Terms, you must not use our Service.
2. Description of Service
2.1 Core Features
Souvi is a photo and video sharing application that allows users to:
- Upload, store, and organize photos and videos
- Create and manage shared albums
- Share content with other Souvi users
- Access content across multiple devices
2.2 Storage Allocation
Free Tier: 5GB of storage at no cost
Premium Storage: Additional storage available for purchase beyond the free 5GB limit
2.3 Service Availability
We strive to maintain high availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance
- Technical difficulties
- Third-party service interruptions
- Force majeure events
3. User Accounts and Registration
3.1 Account Creation
To use Souvi, you must create an account by providing:
- A valid email address
- A secure password
- A username (subject to availability)
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using strong, unique passwords
3.3 Account Termination
You may delete your account at any time through the app settings. Upon account deletion:
- Your content will be permanently deleted within 30 days
- Your subscription will be cancelled (subject to refund policy)
- Your username may become available for others to use
4. Acceptable Use Policy
4.1 Permitted Use
You may use Souvi only for lawful purposes and in accordance with these Terms. You agree to use the Service responsibly and respectfully.
4.2 Prohibited Content
You must not upload, share, or distribute content that:
- Contains nudity, sexually explicit material, or pornography
- Depicts violence, harassment, or threats
- Violates intellectual property rights of others
- Contains hate speech, discrimination, or promotes illegal activities
- Includes personal information of others without consent
- Contains malware, viruses, or other harmful code
- Violates privacy rights or applicable laws
4.3 Prohibited Activities
You must not:
- Attempt to hack, reverse engineer, or compromise our systems
- Use automated tools to access or interact with the Service
- Create fake accounts or impersonate others
- Spam, harass, or abuse other users
- Share your account credentials with others
- Use the Service for commercial purposes without permission
Violation Consequences: Violation of this Acceptable Use Policy may result in content removal, account suspension, or permanent ban from the Service.
5. Content and Intellectual Property
5.1 Your Content
You retain ownership of all photos, videos, and other content you upload to Souvi. However, by uploading content, you grant us:
- A non-exclusive license to store, display, and transmit your content as necessary to provide the Service
- The right to make copies for backup and security purposes
- Permission to compress or reformat content for optimal performance
5.2 Shared Content
When you share content with other users:
- You grant those users permission to view and download the shared content
- You remain responsible for ensuring you have rights to share the content
- You can revoke sharing permissions at any time
5.3 Our Intellectual Property
The Souvi app, including its design, features, and underlying technology, is our intellectual property. You may not:
- Copy, modify, or create derivative works
- Use our trademarks or logos without permission
- Reverse engineer or attempt to extract source code
5.4 Copyright Infringement
We respect intellectual property rights and will respond to valid DMCA takedown notices. If you believe content infringes your copyright, contact us with:
- Description of the copyrighted work
- Location of the infringing content
- Your contact information
- Statement of good faith belief
- Statement of accuracy under penalty of perjury
- Your physical or electronic signature
6. Payment Terms and Premium Features
6.1 Free Service
Souvi provides 5GB of storage at no cost. No payment information is required for the free tier.
6.2 Premium Storage
Additional storage beyond 5GB requires a paid subscription:
- Payments are processed securely through Stripe
- Pricing is displayed clearly before purchase
- Subscriptions automatically renew unless cancelled
- Storage allocations take effect immediately upon payment

6.4 Billing and Renewal
- Billing Cycle: Monthly or annual (as selected)
- Auto-Renewal: Subscriptions renew automatically
- Payment Failure: Service may be suspended for failed payments
- Price Changes: 30 days notice for price increases
6.5 Taxes
Prices may be subject to applicable taxes based on your location. Tax amounts will be clearly displayed before completion of purchase.
7. Cancellation and Refund Policy
7.1 Cancellation Rights
You may cancel your subscription at any time through:
- Account settings in the app
- Contacting customer support
- Your payment provider (for some payment methods)
7.2 Effect of Cancellation
Upon cancellation:
- You retain access until the end of your current billing period
- No further charges will be made
- Your account reverts to the free 5GB tier
- Content exceeding 5GB may be deleted after a grace period
7.3 Refund Policy
Refunds are generally not provided for subscription services, except:
- EU/UK Consumers: 14-day cooling-off period for new subscriptions
- Technical Issues: Refunds for service outages exceeding 24 hours
- Billing Errors: Refunds for incorrect charges
- Legal Requirements: As required by applicable consumer protection laws
7.4 Refund Process
To request a refund:
- Contact support within 30 days of the charge
- Provide order/transaction details
- Explain the reason for the refund request
- Refunds will be processed within 5-10 business days if approved
8. Data Protection and Privacy
Your privacy is important to us. Our data practices are governed by our Privacy Policy, which covers:

9. Service Modifications and Termination

- Implement new terms and conditions
- Temporarily suspend service for maintenance
9.2 Service Termination
We may terminate or suspend your account if:
- You violate these Terms of Service
- You engage in fraudulent or illegal activities
- Your account remains inactive for an extended period
- We discontinue the Service entirely
9.3 Effect of Termination
Upon termination:
- Your access to the Service will be immediately suspended
- Your content may be deleted after a reasonable notice period
- Outstanding subscription fees remain payable
- These Terms continue to apply to past use
10. Disclaimers and Limitation of Liability
10.1 Service Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties, including:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted or error-free operation
- Security against data loss or unauthorized access
10.2 Limitation of Liability
To the maximum extent permitted by law, our liability is limited to:
- The amount you paid for the Service in the 12 months preceding the claim
- Direct damages only (no indirect, consequential, or punitive damages)
- Claims brought within one year of the incident
10.3 Data Backup Responsibility
Important: While we implement backup procedures, you are responsible for maintaining your own copies of important content. We strongly recommend regular backups of your photos and videos.
10.4 Third-Party Services
We are not responsible for:
- Firebase infrastructure issues beyond our control
- Stripe payment processing problems
- App store policies or availability
- Internet connectivity issues
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of the Service
- Content you upload or share
- Your violation of others' rights
- Your violation of applicable laws
12. Dispute Resolution
12.1 Informal Resolution
Before initiating formal proceedings, we encourage users to contact us directly to resolve disputes amicably.
12.2 Governing Law
These Terms are governed by French law, without regard to conflict of law principles.
12.3 Jurisdiction
Any disputes will be resolved in the courts of French law, except where consumer protection laws require local jurisdiction.
12.4 EU Consumer Rights
If you are an EU consumer, you may be entitled to bring proceedings in your Member State of residence, and nothing in these Terms affects your statutory consumer rights.
13. Miscellaneous Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
13.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full force.
13.3 No Waiver
Our failure to enforce any provision does not constitute a waiver of our rights.

We may assign these Terms, but you may not assign your rights without our consent.

We are not liable for delays or failures due to circumstances beyond our reasonable control.
14. Updates to Terms
We may update these Terms from time to time. When we do:
- We will post the updated Terms in the app
- We will update the "Last Updated" date
- For material changes, we will provide 30 days notice
- Your continued use constitutes acceptance of the new Terms
If you don't agree to the updated Terms, you must stop using the Service and may delete your account.
